Do I need to join a consortium too?
Only if you have CDL drivers subject to random testing — federal law requires them to be in a random pool, and you can’t be a pool of one. For that, enroll in the consortium; for a single test, just order one.
When does a driver need a pre-employment DOT drug test?
Before a driver performs any safety-sensitive function — which includes driving a CMV that requires a CDL — the employer must receive a verified negative pre-employment result under 49 CFR 382.301. Not before the offer, not within the first week: before the first time they drive for you.
What triggers a DOT post-accident test?
Under 49 CFR 382.303, you must test after a crash involving a fatality, or when the driver is cited and the crash caused a vehicle to be towed away or an injury needing immediate medical treatment away from the scene. A fatality triggers a test whether or not the driver was cited. The clock is tight — alcohol within 8 hours, drugs within 32 hours — and if you miss the window you must document why.
Who is the MRO, and why does my result go through them?
The Medical Review Officer is a licensed physician required by 49 CFR Part 40 who reviews every lab result before it reaches you. If a specimen screens positive, the MRO privately contacts the driver to check for a legitimate medical explanation — like a valid prescription — before verifying it. You only ever see the MRO-verified result, which protects both you and the driver.
My driver has a recent negative test from another carrier — can I use it?
Generally no. The pre-employment test belongs to the employer relationship, so each new motor carrier needs its own verified negative result before the driver operates. There is a narrow 30-day exception in 49 CFR 382.301 for drivers coming from a compliant program, but verifying it is usually more work than simply ordering a test. When in doubt, test.
How long do I have to keep DOT testing records?
Retention is set by 49 CFR 382.401 and varies by type: verified positives, refusals, and return-to-duty records for 5 years; collection-process records and annual summaries for 2 years; negative and canceled results for 1 year. Keep them secured and separate from the driver qualification file — an auditor will ask for the chain-of-custody paperwork and MRO reports.
