AEB Is Mandatory on New Class 8 Trucks by 2027. LiDAR Is How It Gets Better.

The AEB mandate is already law. Bendix and Aeva are building LiDAR into the trucks you'll buy in two years — and the liability is still yours.

The final rule is published. As of January 2025, NHTSA requires automatic emergency braking on every new Class 7 and 8 truck — deadline 2027. Class 3 through 6 follow in 2028. You don't get to decline it on the next spec sheet. The only question worth asking is how well these systems actually work in the scenarios that kill people.

The AEB Mandate Is Already Law

NHTSA projects the rule will prevent approximately 19,000 crashes and save 155 lives per year. That math belongs to the agency, not the suppliers selling you the hardware.

If you spec a new Class 8 after 2027, AEB is in the truck. Full stop.

Why Radar and Cameras Aren't Enough

Current collision mitigation systems run on radar and cameras. Radar struggles with soft targets — pedestrians especially. Cameras go blind in the dark. Both failures show up in the same place: a nighttime interchange where someone steps off a curb into your path.

The Bendix/Aeva collaboration targets exactly those two failure cases. The joint program is built around pedestrian automatic emergency braking and nighttime collision mitigation as the stated engineering goal, not as options on a feature list.

What separates 4D LiDAR from the sensor tech already in your truck is velocity data. Standard LiDAR builds a point cloud — it sees objects. Aeva's 4D system measures how fast each point in that cloud is moving. When a pedestrian steps into the lane, the system knows instantly that the object is moving and in which direction. That matters at 65 mph in the dark in a way that radar and cameras cannot match.

Aeva's co-founder and CEO Soroush Salehian described the Bendix deal as:

"an indication of 4D LiDAR's maturity and flexibility for high-volume active safety applications beyond autonomy."

This isn't a prototype. This is a production-track program aimed at the roughly 300,000 Class 8 trucks that enter North America every year.

Bendix Is Already in Your Truck

If you drive a Kenworth, Peterbilt, International, or Volvo, you're already sitting on Bendix iron. Bendix's Fusion ADAS platform is available across most major Class 8 OEM platforms: PACCAR, Navistar, and the Volvo Group. Bendix, a subsidiary of Knorr-Bremse, employs more than 3,600 people and holds the dominant position in North American commercial vehicle collision mitigation.

That distribution is why this deal is bigger than a lab announcement. Aeva's sensors aren't going into a handful of test trucks. They're going into the ADAS platform that already sits behind most new Class 8 cabs sold in this market.

On cost: a fleet of 10,000 to 15,000 trucks could require 100,000 sensors. Large-carrier volume commitments are what push LiDAR pricing toward radar parity. Smaller operators ride that cost compression without negotiating a single deal. Nobody running a two-truck operation will see that called out in a press release, but it's real.

Read the Fine Print on Liability

Here's the part of the joint release that didn't get much attention.

Buried in the same announcement celebrating next-generation safety technology, Bendix stated plainly:

"No commercial vehicle safety technology... replaces a skilled, alert driver. Responsibility for safe operation remains with the driver at all times."

That is not boilerplate. That is a legal position written by lawyers, reviewed by lawyers, and approved by lawyers before it went out under Bendix's name. It tells you exactly where the liability lands when the system doesn't stop in time.

Adding ADAS to a truck doesn't reduce your exposure in a crash lawsuit. It may raise the standard of care you're expected to meet. A plaintiff's attorney will ask what training your drivers received on the system's limitations. "It came with the truck" is not a defense. It is an invitation to argue that you put a driver behind equipment they weren't qualified to operate.

Document accordingly. Now. Before these trucks arrive.

What Small Fleets Should Do Before 2027

The truck you're buying right now probably won't have LiDAR-based AEB. The truck you buy in late 2027 or 2028 very likely will. That gap is your planning window.

Start by asking your dealer what ADAS platform is in every new spec. Know whether you're buying into Bendix Fusion or a competing system. Understand what the system is designed to do and what it explicitly is not designed to do.

Then build the paper trail. A short written policy covering ADAS capabilities and limitations. A signed driver acknowledgment. A training log. None of this costs real money. All of it matters when discovery starts after a crash.

Driver qualification records matter more with ADAS in the cab, not less. The baseline 49 CFR Part 391 documents — CDL, medical card, MVR, drug test, Clearinghouse query — are table stakes. Training records on onboard safety systems are what the next generation of litigation is going to reach for first.
